1. Service Description

GumYum ("we", "us", "our") provides game server hosting services, including but not limited to Minecraft servers. Our infrastructure is operated in partnership with unsandbox.com, which provides the underlying container orchestration, networking, and compute resources.

The service offers:

• Dedicated game server instances with configurable resources
• Instant freeze/unfreeze capability for cost-effective hosting
• Multiple world slots for server variety
• Public server browser for community discovery
• Automatic popularity-based scaling (paid tiers)
• Team management for guild/organization servers

2. Infrastructure Partnership

GumYum operates on infrastructure provided by unsandbox.com. By using GumYum, you acknowledge and agree that:

• Your server data is processed and stored on unsandbox.com infrastructure
• unsandbox.com's Terms of Service and Privacy Policy apply to the underlying infrastructure
• Both GumYum and unsandbox.com may take action to enforce acceptable use policies
• Service availability depends on unsandbox.com infrastructure uptime

3. Account & Authentication

Email-Based Authentication:

• Accounts are created and accessed using email-based one-time passwords (OTP)
• You must provide a valid email address to create an account
• You are responsible for maintaining access to your email account
• We send login codes to your email - no passwords are stored
• Account recovery requires access to your registered email

4. Acceptable Use

You agree to use the service only for lawful purposes. Prohibited activities include:

• Hosting servers that facilitate illegal activities
• Distributing malware, cheats, or exploits through your server
• Harassment, hate speech, or discriminatory content
• Impersonating other servers or players
• Attempting to circumvent resource limits or security measures
• Using servers for cryptocurrency mining
• Denial of service attacks or deliberate service disruption
• Reverse engineering or attempting to extract service internals
• Violating game publisher terms of service or EULA

5. Payment & Subscriptions

Subscription Terms:

• Free tier available with limited resources (3 worlds, 7 players)
• Paid subscriptions unlock additional resources and features
• Payments accepted via credit card (Stripe) and cryptocurrency (Bitcoin, Litecoin, Monero, Dogecoin)
• Subscriptions are billed according to selected term (monthly, yearly)
• Yearly plans receive discounts as advertised

Refund Policy:

• Card payments may be refunded within 7 days if no server has been created
• Cryptocurrency payments are final after blockchain confirmation
• No refunds for accounts suspended due to policy violations
• Unused subscription time is not refundable

6. Server Content & Ownership

Your Content:

• You retain ownership of worlds, configurations, and content you create
• We receive a limited license to host and serve your content
• You are responsible for all content hosted on your servers
• You must have rights to any custom content (maps, mods, plugins) you upload

Server Data:

• Server data is preserved during sleep/freeze states
• Data is retained for 30 days after subscription expiration
• After 30 days, inactive server data may be permanently deleted
• We recommend maintaining backups of important world data

7. Service Limits & Availability

Resource Limits:

• Free: 0.5 vCPU, 1GB RAM, 3 worlds, 7 players
• Starter: 1 vCPU, 2GB RAM, 99 worlds, 21 players
• Guild: 2 vCPU, 4GB RAM, 999 worlds, 42 players, team management
• Paid tiers include automatic popularity boost scaling

Service Level:

• Service provided "as-is" with reasonable uptime expectations
• No formal SLA - we make best efforts for availability
• Scheduled maintenance will be announced when possible
• We reserve the right to modify or discontinue features with notice

8. Account Suspension & Termination

We reserve the right to suspend or terminate accounts for:

• Violation of these Terms of Service
• Abusive behavior toward other users or staff
• Fraudulent payments or chargebacks
• Hosting illegal or harmful content
• Security threats to the service or other users

Suspended accounts forfeit remaining subscription time - no refunds for violations.

9. Disclaimers & Liability

Service Disclaimers:

• Service provided "AS-IS" without warranties of any kind
• No guarantee of server uptime or data integrity
• We take no liability for any damages, losses, or issues arising from service use
• Not liable for data loss, server downtime, or service interruptions
• Not responsible for player conduct on your servers
• Not liable for financial losses, business interruption, or consequential damages
• Use of this service is entirely at your own risk

10. Game Publisher Rights

GumYum is an independent hosting service and is not affiliated with, endorsed by, or sponsored by any game publishers (including Mojang, Microsoft, or others). All game names, trademarks, and intellectual property belong to their respective owners. You must comply with all applicable game EULAs and terms of service.

11. Modifications

We reserve the right to modify these Terms of Service at any time. Continued use of the service after modifications constitutes acceptance. Major changes will be announced via email or service notifications.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with US jurisdiction.
